General provisions

The text below constitutes the regulations of the online store run at www.moodjewels.store The operator of the store is Mood Jewels Marlena Kubiś., hereinafter referred to as the STORE, based in Warsaw at ul. Zabłocińska 11a/5, NIP no.: 8491480679, REGON no.: 280380913

Any complaints regarding the method of providing services resulting from ignorance or non-compliance with these regulations will not be considered.

Orders

1.Orders can be placed via the STORE website or e-mail to the following address: hello@moodjewels.store

2. The online store sells products via the Internet.

3. The execution of an order placed on weekdays begins no later than the next business day.

4. Placing an order in the online store is tantamount to accepting these regulations.

5. Information about products in the online store www.moodjewels.store do not constitute an offer within the meaning of the Civil Code, but an invitation to conclude a contract. By completing the order form, the Customer submits an offer to purchase a specific product.

6. The Seller reserves the right to refuse to process the order, limit the payment method or require prepayment.

7. The photos and other forms of visualization and presentation of jewelry presented on the store's website do not reflect its actual size and are for information purposes only..

8. All goods offered by the SHOP are brand new, free from legal and physical defects.

9. It is possible to make changes to the order until the STORE receives payment for the order.

10. Cancellation of the order is possible until it is sent to the Buyer.

Prices

11. The price given for the offered goods is binding at the time of placing the order by the Buyer.

12. All prices of goods offered by the SHOP include the applicable tax on goods and services (VAT).

13. At the customer's request, a VAT invoice is issued in accordance with applicable regulations.

14. The Seller reserves the right to change the prices of products on offer, introduce new products to the online store's offer, conduct and cancel promotional campaigns on the store's websites, or make changes to them.

Guarantee

15. Taking into account the delicate nature of the products, the company stipulates that broken chains are not subject to warranty repair, as such damage can only occur as a result of improper use.

16. The warranty for the products lasts one year from the customer's receipt of the product. It applies to damage resulting from manufacturing defects in jewelry. However, it does not cover mechanical damage resulting from improper use of the product.

17. MOOD JEWELS jewelry items are made of 925 silver.

We cover gold-plated products with a thick layer of 24k gold, but please remember that gold-plated silver jewelry is subject to natural abrasion during use. This is normal and is not a reason for complaint.

Darkening of jewelry is a natural process and is not subject to complaint.

18. Acceptable forms of payment:
a) via the ApplePay online payment system

b) entities providing online payment services are Przelewy24 and PayPal.

 Delivery

19. Delivery of the ordered goods is carried out via courier companies or by delivery to InPost parcel lockers

20. Delivery costs are borne by the Buyer

21. The order processing time is up to 18 business days counted from the moment of obtaining positive payment authorization (in the case of transfers and card payments).

22. Before collecting the ordered goods, the Buyer is obliged to check the condition of the shipment and, in case of any reservations, request the carrier to prepare a damage report and immediately contact the STORE.

23. The SHOP is not liable for failure to meet the deadline for reasons beyond its control, in particular in the event of force majeure. If there are reasons that make it impossible to complete the order within the time specified on the store's website, the Seller will immediately notify the Customer about them, providing the expected order processing time. In such a case, the Customer may withdraw the order.

Return

24. To the buyer, is entitled pursuant to Art. 27 of the Consumer Law, the right to withdraw from a distance contract without giving a reason and without incurring costs, except for the costs specified in Art. 33, art. 34 Consumer Law.

The deadline for withdrawing from a distance contract is 14 days from the receipt of the shipment by the buyer, and to meet the deadline, it is enough to send a statement before its expiry.

The Buyer is obliged to return the item to the Seller immediately, but no later than 14 days from the date on which he withdrew from the contract.

You can withdraw from the contract within 14 days from the date of receipt of the product, and the product must be returned within 14 days from the date of withdrawal from the contract.

25. Return of goods as part of withdrawal from the contract is possible if:

  • the goods have not been used or damaged in any way.
  • returned goods must be complete (they cannot be without hangers or tags).
  • Rings are not subject to returns because they are made to the customer's individual order. However, they can be exchanged for a smaller/larger size.

26. In the event of withdrawal from the sales contract, the buyer returns the goods at his own expense and the seller returns the total cost of the purchased goods.

The SELLER will immediately, no later than within 14 days from the date of receipt of the declaration of withdrawal from the contract submitted by the Buyer, refund to the Buyer all payments made by him, including the costs of delivering the goods, and if the Buyer has chosen a delivery method other than the cheapest standard delivery method offered by the Seller , the Seller will not reimburse the Buyer for additional costs in accordance with Article 33 of the Consumer Law.

The SELLER refunds the payment using the same payment method used by the Consumer, unless the Buyer has expressly agreed to a different payment method that does not involve any costs for him.

The SELLER may withhold the refund of the payment received from the Buyer until he receives the item back or until the Buyer provides proof of sending it back, depending on which event occurs first.

27. The refund will be transferred to the buyer's account (indicated when returning the goods) within 14 days from the date we receive the shipment.

29. If there is a need to refund funds for a transaction made by the customer with a payment card, the seller will refund the amount to the bank account assigned to the Ordering Party's payment card.

Complaint about a purchased product

30. The Seller pursuant to Art. 5581 of the Civil Code completely excludes liability towards customers for physical and legal defects (warranty)..

31. Complaints will not be accepted by the seller if the goods have been in contact with perfumes, body lotions or other liquids that may react chemically with products from the www.moodjewels.store store.

32. The Seller is released from liability under the warranty if:

32.1. The buyer knew about the defect at the time of concluding the contract;

32.2. The Seller is not liable to the Buyer for the fact that the sold item does not have the properties resulting from public assurances if he did not know these assurances or, judging reasonably, could not know them or they could not influence the Buyer's decision to conclude a sales contract, or if their the content was corrected before concluding the sales contract.

32.3. If the sold item has a defect, the Buyer may submit a declaration of price reduction or withdrawal from the contract, unless the Seller immediately and without excessive inconvenience to the Buyer replaces the defective item with a defect-free one or removes the defect. This limitation does not apply if the item has already been replaced or repaired by the Seller or the Seller has not fulfilled the obligation to replace the item with a defect-free one or remove the defect.

32.4. The Buyer may, instead of removing the defect proposed by the Seller, request that the item be replaced with a defect-free one, unless bringing the item into compliance with the contract in the manner chosen by the Buyer is impossible or would require excessive costs compared to the method proposed by the Seller. When assessing the excess of costs, the value of the item free from defects, the type and significance of the defect found, and the inconvenience to which the Buyer would be exposed to another method of satisfaction are taken into account.

32.5. The reduced price should be in such proportion to the price resulting from the contract that the value of the item with a defect remains to the value of the item without the defect.

32.6. The buyer may not withdraw from the contract if the defect is insignificant. If only some of the items sold are defective, the Buyer's right to withdraw from the contract is limited to the defective items.

33. Complaints may be submitted in writing by sending to: Mood Jewels Marlena Kubiś, ul. Zabłocińska 11a/5, 01-697 Warsaw.

34. The complaint form should include: Name and/or description of the product, order number, data of the complainant (Name and Surname, contact telephone number, e-mail and address), along with a detailed description of the physical defects of the goods complained about.

35. Complaints are submitted by sending the product at the buyer's expense to the seller's address, together with a written declaration of intent to use the complaint procedure.

36. Complaints are considered within 14 days from the date of receipt of the declaration of will to use the complaint procedure and the product.

37. If the complaint is accepted, the product will be repaired or replaced with an identical product without defects. If repair or replacement is not possible, the Seller will refund the price of the product to the Buyer, to the bank account indicated by the Buyer in the declaration of will to use the complaint procedure.

38. If the complaint is not accepted, the seller will inform the customer, who can collect the product from the seller.

39. In the event of non-compliance with the contract, physical defects and damage occurring during delivery, the customer has the right to use the complaint procedure described below. To the extent not regulated in the provisions below, the provisions of the Act and the Civil Code shall apply.

Personal data

40. Personal data of Buyers and persons who have registered an account in the store are not made available to third parties, and their acquisition and collection is solely intended to enable the execution of orders.

41. The administrator of personal data is MOOD JEWELS Marlena Kubiś with its registered office in Warsaw, ul. Zabłocińska 11a/5 01-697 Warszawa using the NIP number 8491480679

42. Buyers and persons who have registered an account in the store have the right to inspect their personal data, supplement it, update it, rectify it, temporarily or permanently suspend its processing or delete it if it is incomplete, outdated, false or was collected in violation of the Act or are no longer necessary to achieve the purpose for which they were collected.

43. The Buyer has the right to request access to your personal data, rectify it, delete it, limit its processing and transfer the data.

44. The buyer's data is stored only for the purpose of implementing the sales contract resulting from the purchase of goods in our store and contacting the buyer in the event of order fulfillment or handling of complaints, returns or exchanges of goods.

45. If you agree to receive the newsletter, the buyer's email address will be used only to deliver the buyer a newsletter that will inform you about promotions and new products appearing in our store.

46. ​​We share the buyer's personal data with entities supporting us in providing services electronically, which include:

  • R2G Polska sp. Z o. o. with its registered office in Warsaw, at ul. Franciszka Klimczaka 1, 02-797 Warszawa, entered into the register of entrepreneurs of the national court register kept by the district court for the capital city of Warsaw. Warsaw, 13th Commercial Division of the National Court Register, under KRS number 0000335110, REGON 141963798, NIP 7010194877. This company provides us with courier services related to the delivery of goods from our store to the customer.

We have a data entrustment agreement with the above company, which ensures that your data is safe.

47. Store customers consent to the processing of personal data within the meaning of the Act of August 29, 1997 on the protection of personal data (consolidated text: Journal of Laws of 2002, No. 101, item 926, as amended) and the Act of July 18, 2002 r. declaration of services by electronic means (Journal of Laws No. 144, item 1204) for the purposes of order fulfillment and promotional, advertising and marketing activities by the store owner and entities cooperating with him.

Final Provisions

48. In matters not regulated in these Regulations, the applicable provisions of Polish law shall apply.
